Welcome to Vawven Brand! The terms “we”, “us” and “our” refer to Vawven Brand. We operate this store and website to provide you with a curated shopping experience (the “Services”). Vawven Brand is powered by Shopify, and our products are fulfilled and white-label printed by Printful, Inc..

By using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not access our Services.

SECTION 1 - ACCESS AND ACCOUNT

  • Age Requirement: By agreeing to these Terms, you represent that you are at least 18 years of age (the age of majority in your jurisdiction).

  • Account Security: You are solely responsible for maintaining the security of your account credentials and for all activity occurring under your account.

  • Truthful Information: You warrant that all information provided (email, billing, etc.) is correct, current, and complete.

SECTION 2 - CONTENT AND INTELLECTUAL PROPERTY

  • Your Content: All information, images, or designs you post or upload ("Content") remain yours.

  • License Grant: By posting Content, you grant Vawven Brand and Printful a worldwide, royalty-free, perpetual license to use, reproduce, and display your Content solely to provide and promote the Services.

  • Prohibited Content: You may not upload content that is illegal, hateful, promotes self-harm, involves child exploitation, or violates intellectual property rights. We reserve the right to remove any Content at our discretion.

  • Our Property: Vawven Brand’s name, logos, and designs are protected by intellectual property laws. You may not use them without prior written consent.

SECTION 3 - OUR PRODUCTS AND ACCURACY

  • Visual Representation: We strive to represent product colors and details accurately; however, we cannot guarantee your device's screen will display them 100% accurately.

  • Product Changes: Descriptions and pricing are subject to change without notice. We reserve the right to discontinue any product at any time.

  • Product Alternatives: If a product is out of stock, it may be substituted with a comparable alternative to avoid fulfillment delays unless you have opted out of this feature.

SECTION 4 - ORDERS AND BILLING

  • Order Acceptance: Your order is an offer to purchase. We reserve the right to decline any order for any reason.

  • Billing: You represent that you are authorized to use the payment method provided and that all billing information is accurate.

  • Personal Use: Purchases are for personal or household use only and are not for commercial resale.

SECTION 5 - SHIPPING AND DELIVERY

  • Risk Transfer: The title and risk of loss for products pass to you upon our delivery to the shipping carrier.

  • Estimates Only: All delivery times are estimates and are not guaranteed. We are not liable for delays caused by carriers or customs.

  • Claims: For lost shipments, claims must be submitted no later than 30 days after the estimated delivery date.

SECTION 6 - RETURNS AND WARRANTY

  • Limited Warranty: We warrant that products will not be materially defective or damaged upon delivery. This warranty lasts for thirty (30) days from delivery.

  • Remedies: For defective items, we will either replace the product or refund the purchase price at our discretion.

  • Exclusions: This warranty does not cover buyer’s remorse, size exchanges (for personalized items), or damage caused by improper handling by the customer.

  • EU/UK Rights: Users in the European Economic Area or UK have a 14-day right to cancel and return orders for any reason, provided the items are not personalized or sealed for hygiene.

SECTION 7 - RELATIONSHIP DISCLOSURE

  • Shopify and Printful: While Shopify powers the store and Printful fulfills the orders, your contract is directly with Vawven Brand. You release Shopify and Printful from claims arising from your transactions with Vawven Brand, including product liability or misrepresentations.

SECTION 8 - PROHIBITED USES

You agree not to use the Services for:

  • Malicious purposes, viruses, or harmful code.

  • Infringing on intellectual property.

  • Harassing, abusing, or defaming employees or others.

  • Sending "spam" or unauthorized advertising.

SECTION 9 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, Vawven Brand, Shopify, and Printful shall not be liable for any indirect, incidental, or consequential damages, including lost profits or loss of data, arising from your use of the Services. Our total liability shall not exceed the actual amount you paid for the specific service or product.

SECTION 10 - GOVERNING LAW AND ARBITRATION

  • Governing Law: These Terms are governed by the laws of the State of North Carolina for all disputes related to Printful fulfillment, or the laws of the jurisdiction where Vawven Brand is headquartered for general store disputes.

  • Arbitration: Most disputes will be resolved through binding arbitration on an individual basis, rather than jury trials or class actions (except for users in the EEA/UK).
